Membership

Temple & Webster is a shopping club for members only. Membership is free. By applying for membership on our web site you warrant that you are at least 18 years of age, resident in Australia and that you are able to form legally binding contracts in Australia.

We reserve the right to decline an application for membership or cancel a membership at our sole discretion and without giving any reasons.

Members may not have more than one active account. You are responsible for all activity on your account and for maintaining the security of your password. We are not liable for any losses caused by someone else using your account. If you believe someone else has accessed your account, you must tell us immediately.

Referrals and referral credit

We may provide you with the ability to send email invitations via our web site or invitations via Facebook to your friends and family for the purpose of inviting them to apply for membership. You agree to send invitations only to people who know you personally, and not to use this feature to send any content which is unlawful, abusive or obscene.

We may from time to time, at our sole discretion, offer to credit the account of the referring member with a fixed sum for use on our web site after the first purchase by a person they have referred (“referral credit”). Referral credits are non-transferrable and cannot be exchanged for cash.

Any abuse of this email messaging feature or referral credit system, including for the purpose of manipulating the referral credit system for financial gain, may result in the cancellation of your Temple & Webster membership and the forfeiture of any referral credit on your account.

Our products

The products for sale on our web site are intended solely for purchase by members for their personal use. You agree not to commercially resell any product you buy from our web site. We may restrict orders to normal household quantities.

We endeavour to ensure that all the products on our web site are accurately described, and we rely on information provided by our suppliers. Unfortunately, on some occasions it is possible that our web site will contain errors and we reserve the right to correct any errors or inaccuracies at any time. You should also be aware that colours may appear slightly differently on different displays and screens.

Your order

After you have placed your order and we have processed your payment we will provide you with an order confirmation by email. This email does not guarantee that the product(s) you have ordered is/are available and our acceptance of your order is not a legally binding obligation to fulfil your order. Your order represents an offer to purchase, which we accept when we dispatch your product(s) and send you an email letting you know that your product(s) has/have been dispatched. In the unlikely scenario where delivery of an order may result in unacceptably high freight charges to Temple & Webster, we reserve the right to cancel an order prior to dispatch. In such circumstances a full refund will be issued. In the unlikely event that a product is unavailable, we will contact you by email as soon as possible to let you know. You may choose to have a credit to your account  or a refund to the value of the unavailable product.

Prices, payment and GST

All prices displayed on our web site are in Australian dollars and include GST and all payments are processed in Australian dollars. We accept payment by Visa, MasterCard, and PayPal.

The retail price for each product is provided to us by our supplier and is shown alongside the sale price for your reference.

Delivery

Delivery costs and times vary for different products and are calculated based on size, weight and destination. Each product listing will include the estimated delivery time frame for that product or sale event, typically, delivery occurs within 2-4 weeks. Where possible we will provide a date range of the expected delivery window. From time to time the delivery of specific items will exceed our usual 2-4 week delivery window. In such cases the estimated delivery time frame will be clearly stated in the product listing details. The delivery price for each order will be displayed during the checkout process, prior to payment and order confirmation. Temple & Webster receives products from our suppliers only after our sale events end and each supplier delivers to us at different times. We strive to process all orders as quickly as possible and we will send you an email to let you know when your item has been dispatched by us.

We will have your purchase delivered using Australia Post or couriered to the delivery address provided by you. We cannot deliver to PO boxes. Australia Post may leave a card at the address and you will need to pick up the delivery from your nearest Post Office. A courier may leave a card if no-one is at the address to sign for the delivery, and you will need to contact the courier company to arrange for re-delivery. We deliver most products Australia-wide. In some cases, we will only be able to deliver products in metropolitan areas. This information will be shown on the product listing.

We are not able to accept orders for international delivery at this time.

Returns

If you change your mind or your order is not quite right for some reason, it can come back to us anytime within 30 days of receipt of your items. Returned items must be unused and in their original packaging. Once we receive your returned item, we'll give you a store credit or full refund of the purchase price (less the initial delivery charge), whichever you prefer.

If your product is faulty or otherwise non-compliant with a consumer guarantee under the Australian Consumer Law we will either replace it (subject to availability) or provide you with a refund of the purchase amount (including the delivery charge).

In most other circumstances, we will provide you with a credit to your Temple & Webster account of the purchase amount (including the delivery charge). Note that we do not hold stock, so exchanges are not usually possible.

Gift Cards

Members may purchase Gift Cards from our web site. We will email the Gift Card to the recipient’s email address, as provided by the member. Recipients of Gift Cards who are not already members will need to apply for membership of Temple & Webster before they are able to use their Gift Card. Membership is free.

Gift Cards, once verified, may only be used for purchases at Temple & Webster. Gift cards are not transferrable and cannot be returned or exchanged wholly or partly for cash. The available funds will be verified at the time of redemption on the Temple & Webster web site. Any balance that remains on a Gift Card may only be used in whole or in part for future purchases at Temple & Webster. Gift Cards have an expiry date 365 days from the date of their purchase and this expiry date cannot be modified. If a purchase made using a Gift Card is for less than the amount of the Gift Card, any remaining balance will appear on the user’s account for future use. Any balance that remains after the expiry date will not be available for use.

Liability

To the extent permitted by law, we exclude our liability for any loss or damage (including but not limited to indirect or consequential losses) arising out of your use of or purchase from our web site. To the extent permitted by law, our liability to you in relation to any product supplied to you is limited to the purchase price of the product.

Intellectual property

We are the owners or licensees of the intellectual property in the content on our web site including (but not limited to) text, graphics, logos, trade marks, design, icons, the arrangement of any of the foregoing, sound recordings, video and all software relating to our web site. You are not permitted to copy, publish or use any of the content in any way, whether personal or commercial, without our prior written permission.

Third party web sites

Our web site may contain links to web sites which are operated by third parties.  We are not responsible for the content of any third party web sites and we suggest you inform yourself of any relevant terms and conditions or privacy policies applicable to those sites.

Email communication

You consent to receive communication from us electronically, either by email or by us posting notices on our web site and you agree that all communications that we provide to you electronically will satisfy any legal requirement that a communication be in writing.

Facebook

The purpose of our Facebook page is to provide Temple & Webster's fans with a little inspiration, information on our sale events, access to special promotions plus the latest going's on at T&W and from our circle of friends. You’re welcome to contribute your own comments, photos & videos.
To ensure a positive and respectful environment for everyone, we ask that you follow a few simple guidelines when making a contribution:
We’re all about the home, specifically, creating a more beautiful home. We welcome contributions on this topic.
We’ll delete posts that we consider to be off-topic, spam, advertising, offensive, sexually inappropriate, threatening, abusive, hateful, profane or defamatory towards a person, race, ethnicity, entity, belief or symbol.
We’re big supporters of lively, open discussion, in particular, we don’t shy away from negative feedback from our customers, we simply deal with it in our usual professional, friendly manner. However, we reserve the right to address factual errors or delete posts if we think it appropriate or necessary to do so.
We’re happy for our material to be shared (via Facebook’s "share" functionality), but we don’t like it when folks copy our material and post it without attribution, or worse, use it for commercial purposes or claim it as their own.

Force Majeure

Temple & Webster is not liable for any delays in performing its obligations caused by circumstances beyond our reasonable control.  We will endeavour to perform our obligations as soon as possible within a reasonable extension of time.

Applicable law

These Terms and Conditions, including our Privacy Policy are governed by the laws of New South Wales, Australia and are subject to the non-exclusive jurisdiction of the courts of New South Wales.
